Vehicle Tracking Laws

Real-time vehicle GPS Trackers have different laws that vary from state to state. Each state has a different law, so it is important to check with a lawyer to make sure that placement of the GPS won’t have any legal issues.

General laws

  • It is generally legal to use a GPS Tracker if you or the organization own the vehicle that is being tracked, or if you are the owner of the asset.
  • It is also usually legal if you are tracking your child that is under the age of 18.
  • Usually, it is legal to track a car or asset for legal repossession in the event of a loan or default.
  • It is usually illegal to use a tracking device if you are not the owner of the vehicle or if you are tracking a boyfriend or girlfriend in their own car.

Laws in the state of Florida

The state of Florida has tracking laws that can be different from other states.

Florida established a new statute that makes it illegal for somebody to place a tracking device unless you are the owner of the vehicle.

The exception to this law is a parent who is the sole guardian of a child, or if both parents consent to place a tracking device to monitor their child.

Another exception to this law is a person with a disability. This can include an Alzheimer’s patient or somebody suffering from dementia.

Using a GPS Tracker illegally in Florida is a second-degree misdemeanor. This can lead to an excessive fine or up to six months of jail time.

It is very important to verify your state laws prior to placing the tracking device. Each state has unique laws so even though it may be completely legal in one state, it can potentially lead to jail time in another state.

The general rule of thumb is that if the vehicle is in completely in your name, you should be permitted to place a GPS Tracking device to monitor the vehicle. However, if you are placing the GPS Tracker on somebody else vehicle, it is most likely illegal and can result in a fine or possibly even jail time.

Again, these laws are state specific so it is very important to consult a lawyer prior to purchasing a tracking device. The laws are also constantly changing in every specific state in the U.S., and it is important to check your state laws before purchasing and activating any GPS Tracker.

Why Should We Hire Family Law Practice

Family law can be defined as a practice that is closely concerned with the legal issues that have to do with family relationships like child custody, divorce and adoption. The lawyers who practice in this area usually deal with divorce, child support and so on. There are those that choose to specialize in emancipation, paternity, and adoption or any matters that relate to divorce. Formal requirements have to be reasonable and that is usually determined by the state. This includes things like legal capacity, age and same sex marriages. The state is also responsible for setting out the procedures and the rules that govern divorce as well as other matters related to family law.

Important terms to family lawyers

Emancipation: this is a process of the court whereby a person or a minor is allowed to be self-supporting. This means that he assumes the responsibilities of an adult for his welfare and won’t be under the parents.

Marital property: this is the kind of property that was acquired by a spouse while they were married and that needs to be divided when they divorce.

Alimony: this is the allowance that is given to a spouse for support when they are legally divorced or separated or when they are awaiting either of the two.

Paternity: the descent or origin from father. Establishing paternity means that you are confirming who the biological father of the child is.

Prenuptial agreement: this is an agreement that is usually made between two parties before they get married. Here, future rights to property are given in case death or divorce occurs.

Why hire a family lawyer?

Many of the family lawyers offer their services during divorce proceedings and other matters that may be related to divorce. Family law is a broad practice however, and it includes areas like reproductive rights and foster care. Some of the reasons as to why you may need a family lawyer include:

Divorce: every partner hires a lawmaker who is responsible for the creation of a settlement plan so as not to go top trail. They are usually people who can be able to divide any marital property, proposing child custody scenarios, and also calculating spousal support.

Child support/ child custody: the court orders and agreements on settlement involve support and custody and can be included in divorce cases that are larger. These can be revisited if any conditions change like the financial standing of a parent.

Paternity: sometimes a mother can file such a case as they try to secure some child support payments from the father. Also, a father can file a paternity case so as to be able to have a kind of relationship with a child. DNA testing is used for the determination.

Adoption: foster care and adoption is both complex. The process can differ and usually factors like where a child is from and state laws can affect the process. A family lawyer can be able to handle all these. A foster parent can sometimes adopt a foster child. The entire foster process sometimes doesn’t require any kind of legal representation.

Do I Need an Attorney for My Divorce?

Many couples debate whether they need a divorce attorney when mediation is required by the courts. It is recommended, at minimum, consulting with a family law attorney about your options and what is best course of action for your case no matter how well you and your ex-spouse get along.

Below you will find just a few examples of the aspects you need to consider if you are debating whether you should hire an attorney for your divorce:

  • If you have many complicated assets to divide up. If you have accumulated various expensive marital property, you should consider hiring a lawyer. You will want to have a lawyer present if you have complicated possessions you are dividing, like businesses, numerous vehicles, and real property.
  • If your spouse is prone to lying. If your former spouse is known to lie, it could become difficult when it is your word versus theirs in a hearing or mediation session. If they are spreading false information about you, or lying in the courtroom, you need a lawyer on your side to protect your interests.
  • If violence or abuse is ever involved. If any abuse is present, whether it’s related to children, substance abuse, sexual abuse, mental abuse, or any other form, you should always hire an attorney. Not only will the abused spouse not be able to negotiate properly for fear of manipulation or further abuse, but a family law attorney can help take the appropriate steps to protect you and your family.
  • If your spouse has hired an attorney. Your spouse may choose to hire a lawyer to represent themselves at the last minute. We see attorneys appear at hearings and mediation with little to no notice to the unrepresented spouse. If your spouse decides to have representation, you should as well. It will be difficult to make your case against a family law attorney, even if you believe you have a clear and reasonable argument.

There is so much at stake! If you are going through divorce and you are debating on whether you need to hire a divorce attorney, call and speak to a family law firm you trust in your area. An experienced attorney should answer the questions you have, discuss your options and your particular case to help you understand your options during divorce. A skilled lawyer may be an invaluable asset to protect your and your family interests.

Copyright Infringement in the Digital World

Downloading files from the internet is not a crime, but if you download files for free which you usually have to pay for, then there’s a problem. The piracy issue occurs when the copyright owners do not get the amount that they are due.

Piracy is the illegal copying and selling of copyrighted materials, but the common misconception is that people don’t think it matters because no one gets hurt. In reality, the evolution of piracy from burning CDs and DVDs to digital copying has affected the global economy. Pirating a physical copy or streaming illegally affects the livelihood of artists too.

Pirated copies are not always great

Most of the time, illegal copies do not have the same quality as the legal content. A pirated movie may have been recorded on a camcorder at the back of a cinema, so the quality is poor. Its content may be grainy or black and white at some parts. Copies downloaded from the internet on the other hand may suddenly stop at some parts and the sound quality can be very quiet and muffled.

Easy digital access

Downloading directly from the computer has become popular among internet users primarily because of the ease of access. Even with the number of sites that offer legal downloads, there are still file-sharing networks that offer free access to copyrighted materials. And it’s sad that many are active in some form of piracy, either through streaming, downloading, or the old school style of buying counterfeit DVDs.

In any case, piracy costs the entertainment industry. It is stealing from the businesses involved in the art. People must remember that nothing is free. Pirate sites make money through subscription costs or advertising when a consumer streams illegal content. The operators of these sites earn from sharing copyrighted materials that they do not own and have no permission to distribute.

How to minimize the problem?

Having internet service providers get on board in helping fight piracy and detect copyright infringements has always been a struggle. It would require content holders to educate people and private entities to be responsible, make them understand the importance of copyright, and encourage them to support different ways to consume content legally like going to the cinema or subscribing to Netflix and other video-on-demand sites.

Piracy may not be easy to kill but it can be reduced. Besides, with all the latest technology coming out, we only need to keep up. Also, there are entities that help fight piracy with the use of software to detect copyright infringements.

What Damages Can I Claim After a Drunk Driving Accident

Being injured in a drunk driving accident can be life-altering. You need to hire a professional personal injury attorney. Only he can educate you regarding the legal process and eventually help you win the case with the best possible compensation.

As per the Florida law, you are a victim of a drunk driving accident if the accident causes you loss of any form that demands compensation. Under Florida Statute for victims of DUI crashes, there are certain “allowances” provided for the victims. However, the victim or his lawyer often requires to pursue these allowances he is subjected to!

You must be aware about the multiple ways through which a victim can obtain benefits. A set of Qualification Requirements has been established by the Florida’s Bureau of Victim Compensation for receipt of funds under its Crimes Compensation Act. Here are the requirements:

  • The reporting of the crime to law enforcement needs to be done within 72 hours.
  • It is necessary for the victim to have suffered some form of personal physical injury. There is an automatic reduction in the funds for those who have just suffered psychiatric or psychological injury due to the accident.
  • Application needs to be filed within the time period of one year after the crime date. In case a valid cause is shown, the time period might be expanded up
  • to 2 years.
  • The victim must cooperate with law enforcement, State Attorney’s Office, and the Attorney General’s Office fully.
  • The victim must not have been engaged in any form of unlawful activity at the time of the accident.
  • The victim must not be responsible for the accident in any way.
  • The victim must not have a record of felony conviction.

What are the benefits available to the victim?

You need to meet all the above criteria in order to be proven as the victim. Only then, as per the Bureau you are entitled to the following benefits:

  • Loss of wage
  • Loss of support such as the death of a close relative etc.
  • Disability of any form
  • Expenses related to funeral
  • Expenses pertaining to medical treatments
  • Mental health counseling
  • Compensation for any kind of Property Loss

However, the truth is that you and your lawyer need to pursue your compensation actively in order to avail all the benefits available under the Florida Law. This specific statute helps to save you a good deal of your medical costs.

An injury caused due to drunk driving accident might cause you loss of time at work and subsequently loss of high wages. You might have to struggle to pay the bills. When your general bills are added on by your medical expenses, you might lose your sleep at night. So, it is more than essential for you to claim lost wages in a drunk driving accident. This includes future wages If the injuries you suffered leaves you disabled or incapable of functioning properly to provide output to the company, you need to count your future wages as well for compensation.
You are also entitled to seek damages for pain and suffering caused by such an accident. This involves the physical or mental distress caused due to someone’s death. You need to prove the nature and severity of your injury as well as the prognosis issued by the doctor with the intent to claim such damages.
Out of all the damages claimed, those related to medical expenses is the most common. This is because in most cases, medical expenses can add up at a striking rate into a lump sum. The situation might be the same even when you have medical and auto insurance. You can demand reimbursement for ambulance rides, consultations, medical equipment, physical therapy, in-home medical care and all other expenditures.
What to do just after a drunk driving accident occurs?
  • Dial 911

When you find out you are the victim in the crash, dial 911. Make sure to receive treatment for your injuries instantly, if possible. Police officials soon test the other driver for the accident.

  • Gather contact information

Collect important contact information. It includes the other driver’s name, contact number, address, and details related to insurance. Also, gather relevant info from the witnesses on the scene. Gather their basic contact information as well since it might come handy later.

  • Gather every possible piece of evidence

Click pictures of the crash scene, the vehicles or vehicles that were involved, and any injuries that you suffered. If there are other pieces of evidence like torn clothing, crashed debris etc., make sure you keep those handy as well.

  • Hire a drunk driving accident attorney

Only the qualified drunk driving attorney has an absolute knowledge on law. At first, the case might seem to be simple but things might get tense with the progression of the case. So, be on the safe side and get yourself a proper attorney with specialization in this field.

Who is usually responsible for drunk driving accidents?
If the person who apparently caused the accident is found to have a BAC that is higher than the legal limit, you can go ahead in filing a lawsuit against him. You can also file a claim against a restaurant or bar if it is responsible for providing alcohol to the person accused for the accident.
  • The accused person needs to be Under 21 years of age.
  • The accused need to be someone who is “habitually addicted” to alcohol.

It is pretty difficult to put the blame or a part of blame on the third parties that might actually be liable for the drunk driving accidents.

Can I Get Ticketed By an Off-Duty Police Officer?

We are thankful for our law enforcement personnel who sacrifice their lives every day to protect our rights and our safety. As citizens, we expect police officers to be honest, respectful, and un-biased figures of society, so that we may trust them to carry out their duties responsibly.

But sometimes, a cop can exhibit overconfidence and carry out personal agendas that are not necessarily a positive contribution to our communities. One common example of this involves off-duty cops and unmarked police vehicles. Continue reading to learn about your rights as a citizen in the case that you are pulled over by an off-duty police officer in an unmarked vehicle.

Off-Duty and Unmarked

Have ever been pulled over by an unmarked police vehicle? They appear to look like any other normal vehicle on the road, and then all of a sudden, you see their flashing lights and sirens in your rearview mirror. Unmarked police cars are purposeful and used in several types of investigations and routine applications. So if you are pulled over in one, by a cop that is actually on-duty, then you are being legally pulled over. However, if you were pulled over by an off-duty police officer in an unmarked vehicle and out of uniform, the situation changes.

According to Indiana Code § 9-30-2-2:

A law enforcement officer that is off the clock and driving in an unmarked vehicle does not have the authority to pull someone over and issue them a citation or ticket.

Accordingly, any evidence gathered by the police officer during an unauthorized stop is suppressible, and carries no weight in a court of law whatsoever. Many drivers have had their citations and tickets revoked under these circumstances, after an attorney successfully presented their argument regarding this Indiana Code.

How to Challenge an Illegal Ticket

It is important to understand the limits of a cop’s authority, and when and where they have jurisdiction. This way, you can know whether or not a ticket is being issued legally. If this has ever happened to you, you might want to consider challenging it, or expunging the violation altogether. Talk to a record expungement lawyer to see if you qualify.

Remember, an off-duty officer in an unmarked vehicle has just as much right to pull you over as you have the right to pull over the car in front of you. So if a cop on his way home from work wants to pull you over, keep this in mind. But of course, never keep driving. It is best to just stop and talk to the police officer. Do not argue, accept the ticket, and then immediately call a defense lawyer when you get home.

What Are the Most Common Forms of Intellectual Property?

Intellectual property (IP) refers to innovations of the mind, such as inventions, scholarly and creative works, patterns and marks, names and likenesses used in trade and business. All IP is protected by the various laws in existence locally, regionally nationally, and internationally. Laws exist for patents, trademarks, copyright, service marks, trade secrets and more.

What is a Patent?

A patent is an absolute right granted for an invention, which is a product or a method that provides, in general, a new way of doing something, or proposes a new specialized solution to a problem. To obtain a patent, methodological information about the invention must be revealed to the public in a patent application. The process for obtaining a patent is complex. If you are interested in obtaining a patent, you should first visit this website: The US Patent and Trademark Office. Once you have begun to understand this process and the associated laws you can apply for a patent. However, keep in mind this is a complex process and using an attorney specializing in patents would be the best avenue to use.

What is copyright?

Copyright is a legal term used to illustrate the rights that creators have over their literary and artistic works. Creations covered by copyright range from books, music, paintings, sculpture, films, computer programs, databases, advertisements, maps, technical drawings, and more. Copyright is not a complex IP to apply for and most people can easily complete a form and submit their work. Be sure to visit the Copyright Office online to learn everything you need to apply for a copyright, including fees, what to submit, etc: US Copyright Office.

What is a trademark?

A trademark is a sign which distinguishes between goods or services of one company from those of other companies. Trademarks are safeguarded by intellectual property rights. Trademark protection can be obtained through registration, by completing an application for registration via the trademark office and paying the required fees. The website is the same as for patents.

What is a Service Mark?

A service mark is a mark that distinguishes between services. Businesses use service marks to connect their services and differentiate them from other services in the same field. Service marks consist of letters, words, symbols, and other devices that help notify consumers about the origin or source of a particular service. Registration can be completed at the US Patent and Trademark Office.

What is a Trade Secret?

The Uniform Trade Secrets Act (“UTSA”) classifies a trade secret as: information, including a formula, pattern, compilation, program, device, method, technique, or process that produces independent economic value. These secrets are either tangible or impending, and generally are not known or easily discovered by other persons who might receive monetary value from its revelation or use; and is the focus of efforts that are logical under the conditions to preserve its secrecy. There are two basic situations in which acquiring the use of a trade secret is illegal. If a trade secret is acquired through illegal means or if through a breach of confidence then there is a legal standing for suit. Trade secrets may be obtained by lawful means such as private discovery, reverse engineering, and unintentional disclosure. The trade secret holder’s failure to take reasonable protective measures can allow this to occur. The misappropriation of trade secrets is considered a form of unfair competition. Reverse engineering is oftentimes restricted as found in computer programs.

What is Industrial Design?

An industrial design right is an intellectual property right that shields the visual design of objects that are not purely functional. An industrial design consists of the creation of a model, pattern or composition of a pattern or color, or permutation of a pattern and color in three-dimensional form containing aesthetic value. An industrial design can be a two- or three-dimensional prototype used to produce a product, industrial commodity or handicraft.

What is Trade Dress?

Trade dress is a legal term of art that generally refers to characteristics of the illustration of a product or its packaging or the design of a building that signifies the origination of the product to consumers.

What is Fair Use?

Fair use is any copying of copyrighted material done for a partial and that changes the purpose, such as to comment upon, disparage, or lampoon a copyrighted work. Such uses can be done without permission from the copyright owner. Fair use is a defense against a claim of copyright infringement.

Commentary and Criticism

If you are commenting upon or criticizing a copyrighted work a book review or any valid review, fair use principles allow you to replicate some of the work to accomplish your purposes.

These are the most common forms of intellectual property. If you decide that something you have created falls under one of the categories stated in this article, then you should look into registering the work or product. Be certain that what you are registering is not the same as what someone else has already registered.

Will The End Of DACA Burst Our Academic Bubble?

Maybe it is okay that the academic bubble is about to burst. After all, our colleges and Universities seem to have lost their way, teaching gender studies, minority (majority) studies, leftist viewpoints and the never ending politically correct mission creep of sustainability, equality, and socialism. Is the removal of DACA – Deferred Action for Childhood Arrivals going to be the straw that breaks the camel’s back in academia? It very well might be. Let’s talk.

There was an interesting piece on NPR worth listening to titled: “California State University Chancellor Raises Concerns About End Of DACA,” part of the ‘All Things Considered’ venue (4 minutes, 14 seconds long). The piece was on the air on September 6, 2017. During the interview the California State University system Chancellor Timothy White, he stated:

“Well, it would make it so several thousand of our students and several hundred of our employees would lose the status that DACA has provided. And for some, that would mean they would drop out of school out of fear. For others, it would mean that they would not be able to get a job or have the sort of ability to function in society once they earn their college degree. So we’re actually deeply disappointed in the president’s action and are working strongly with, now, our congressional members to create legislation to reverse this.”

Personally, I bet it is much higher than that, I bet it’s at least 5,000 students at 500 University employees. First, why is the University hiring Illegal Aliens ahead of US Citizens? Second, are these 5,000 students borrowing monies (student loans) for their over-priced tuition? You know, college is FREE in Mexico, but I guess if they don’t pay back the student loans its FREE here too, for them only as all the citizen college students can’t get out of their student loans ever, or those on Student VISAs have to pay in exorbitant college tuition fees in advance often 3-times the normal rates. Next is this issue with Cal Grant program – who do you think pays for that?

Meanwhile, most of the University professor pension funds around the country are in trouble (underfunded) and their pay keeps increasing, and the Universities continue to hire more administrators to their already bureaucratic and top-heavy brain-washing institutions.

Now you might ask, why on Earth does this author (me) care? Well, I am a taxpayer. And, I understand the issues of social safety nets, but our taxes are paid by US citizens for our benefits, not to redistribute to folks who are in our country illegally. Yes, I understand the debate; “it’s not their fault, their parents brought them here at a young age, and this is the only country they know.” Understood, but that is not my fault, nor should it be my problem just because I am a white male.

It seems now we are in a Catch-22. You see, if we send all the DACA students back, they will not pay their student loans, and will finish their education in Mexico, where it is free, which might be enough to trigger a bubble burst in the student loan market causing severely decreased enrollment as no one will be able to get a student loan in the future; citizen or not. Fewer students means tuition revenues will decrease, layoffs of staff and professors will cause poor education, larger classrooms, and bankruptcy to many University systems nationwide. And, mind you, the academic bubble will eventually burst as it is “unsustainable” anyway, but this may accelerate the time to drive off that cliff.

It’s too bad academia got hijacked by leftist political forces, now it’s time that the pendulum swings back to some sense of normalcy. Maybe it’s going to take a big hit to the system to force a little common sense back into the University system, maybe this DACA reversal might be that event that pivots to a more reality based place of higher learning?
